Drug Crimes

Drug charges can threaten your freedom, employment, education, and future opportunities. Felty Law Firm provides strategic defense for individuals facing drug possession, distribution, trafficking, manufacturing, and conspiracy allegations in Virginia state and federal courts.

What Drug Crimes Are Prosecuted in Virginia?

Virginia drug charges range from simple possession to large-scale distribution and conspiracy allegations. The offense level and potential penalties depend on the controlled substance, its schedule, the alleged quantity, the accused person’s intent, prior convictions, and other circumstances. Possession of a Schedule I or II controlled substance is generally prosecuted as a Class 5 felony, while distribution of those substances can carry substantially greater prison exposure and financial penalties. Drug-crime cases may involve allegations of:

  • Possession of a controlled substance
  • Possession with intent to distribute
  • Manufacturing or distributing drugs
  • Prescription-drug offenses
  • Drug trafficking
  • Conspiracy to distribute controlled substances
  • Distribution as an accommodation
  • Possession of drug-manufacturing materials
  • Distribution near protected locations
  • Drug charges involving firearms or alleged organized activity

The distinction between possession and possession with intent to distribute is especially important. Prosecutors may rely on drug quantity, packaging, scales, cash, communications, witness testimony, or other circumstantial evidence to allege an intent to distribute, even when no completed sale was observed. State investigations may also become federal cases when they involve federal agencies, interstate activity, extensive quantities, multiple defendants, or an alleged distribution network.

How Can a Drug Charge Be Challenged?

A drug arrest does not automatically establish lawful possession, intent to distribute, or participation in a conspiracy. The prosecution must prove every required element with admissible evidence. A defense attorney begins by examining how law enforcement obtained the evidence, whether the accused knowingly possessed the substance, and whether the facts support the specific offense charged.

Important issues may include:

  • Whether officers had legal grounds for a traffic stop, detention, or arrest
  • Whether a search warrant was supported by probable cause and properly executed
  • Whether an exception to the warrant requirement actually applied
  • Whether the accused knew the substance was present and exercised control over it
  • Whether drugs found in a shared home or vehicle can be linked to a particular person
  • Whether laboratory testing accurately identified the substance and quantity
  • Whether chain-of-custody requirements were satisfied
  • Whether statements were voluntary and obtained lawfully
  • Whether confidential informants, cooperating witnesses, or controlled purchases are reliable
  • Whether the evidence proves distribution or conspiracy rather than mere association or possession

When evidence was obtained through an unlawful search or seizure, counsel may seek to have it suppressed. Other cases may turn on forensic testing, witness credibility, digital communications, ownership of the location searched, or the government’s interpretation of circumstantial evidence. Felty Law Firm evaluates these issues to determine whether dismissal, suppression, reduced charges, negotiation, or trial is the appropriate strategy.
