DUIs & DUIDs

Facing a DUI or drug-impaired driving charge in Washington County, Smyth County, or Bristol, Virginia? What Happens After a DUI or DUID Arrest in Virginia?

A Virginia DUI charge may involve an alleged blood alcohol concentration of 0.08% or higher, observed impairment by alcohol, impairment by drugs, or the combined influence of alcohol and drugs. DUID means driving under the influence of drugs, and these cases are prosecuted under the same Virginia statute governing alcohol-related DUI offenses. Prescription medication, illegal drugs, and other self-administered intoxicants may become part of a DUID investigation when law enforcement alleges that they impaired the driver’s ability to operate a vehicle safely. Virginia Code § 18.2-266

After an arrest, the driver may face an immediate administrative license suspension, a court date, and a separate refusal charge if law enforcement alleges an unreasonable refusal of a required breath or blood test. An arrest is not a conviction, and the prosecution must still prove the required elements of the charged offense.

A DUI defense attorney may review:

  • Whether the officer had a lawful reason for the traffic stop.
  • Whether sufficient grounds existed for the arrest.
  • Body-camera footage, dash-camera footage, and officer reports.
  • The administration and interpretation of field sobriety tests.
  • Breath-testing procedures, equipment records, and test results.
  • Blood collection, laboratory testing, and chain-of-custody evidence.
  • Medical conditions, prescribed medications, and alternative explanations.
  • Statements allegedly made before or after the arrest.
  • Whether implied-consent and refusal procedures were properly followed.

A conviction may affect driving privileges and can involve fines, probation, alcohol-safety programming, ignition-interlock requirements, or incarceration. The potential consequences depend on the evidence, prior offenses, alleged alcohol or drug concentration, accident circumstances, and other factors. Former prosecutor Matthew Felty evaluates each case individually and helps clients understand the evidence, possible defenses, licensing concerns, and next steps in the Virginia DUI court process.

What Are the Penalties for a DUI or DUID in Virginia?

A first DUI or DUID conviction in Virginia is generally a Class 1 misdemeanor carrying a mandatory minimum fine of $250 and a one-year loss of driving privileges. The court may also impose probation, require completion of the Virginia Alcohol Safety Action Program (VASAP), and order ignition-interlock restrictions when applicable. A restricted driver’s license may be available in some cases, but eligibility and operating conditions depend on the circumstances.

Potential penalties become more severe when a case involves an elevated blood alcohol concentration, a prior DUI conviction, an unreasonable refusal allegation, a minor passenger, an accident, or an injury. A third qualifying DUI offense within 10 years may be prosecuted as a Class 6 felony, carrying mandatory incarceration and an indefinite license revocation. Beyond the sentence imposed by the court, a conviction can affect automobile insurance, employment, professional licensing, and commercial driving privileges. Because the consequences are highly fact-specific, every DUI or drug-impaired driving charge should be evaluated individually. Virginia DUI penalties | Virginia license consequences
